BY COMPLETING THE ELECTRONIC ACCEPTANCE PROCESS AND CLICKING THE “SUBMIT” BUTTON, YOU REPRESENT AND WARRANT THAT YOU: (i) ARE AUTHORIZED TO SIGN FOR AND BIND THE CONTRACTING PARTY AND (ii) AGREE TO BE BOUND BY ALL OF THE TERMS AND CONDITIONS OF THIS AGREEMENT, INCLUDING THE DISCLAIMERS AND LIMITATIONS OF LIABILITY SET FORTH IN APPLICABLE SECTIONS BELOW.
1. Kongkow.com provides Kongkow Conference products.
2. DESCRIPTION OF SERVICES: We provide conference call services. Conference calls are also known as audio conference, tele conference, or conference calling. This service allows users from various locations to dial into a single dial-in number, enter the same PIN code and connect all of their phone lines. Our Website is provided for the benefit of customers interested in or Registered and/or subscribed to use our Services (as applicable). We administer the Website from Indonesia and through our service providers who may or may not be based in Indonesia.
3. REGISTRATION. To use our services, You must submit a complete registration, which is available at http://www.Kongkow.com, on Your behalf. In connection with Your use of the Website and Services, You will be required to complete a registration form creating an account. You represent and warrant that all information You provide on any registration form or otherwise in connection with Your use of the Website or Services will be complete and accurate, and that You will update that information as necessary to maintain its completeness and accuracy. The information requested on original signup shall be referred to as registration data ("Registration Data"). If Kongkow.com discovers that any of Your Registration Data is inaccurate, incomplete or not current, Kongkow.com may terminate Your right to access and receive the services immediately upon notice.
4. CONSENT TO RECEIVE EMAIL: By establishing an account with Kongkow.com, You consent to receive periodic email communications from Kongkow.com concerning Kongkow.com’s products and services, including without limitation Kongkow.com’s periodic newsletter, occasional service update bulletins, and summary emails regarding scheduled conferences before and after they are complete. Some of these e-mail services may not be applicable to the Kongkos Conference’s basic products.
5. PIN CODE. Kongkow.com provides PIN code for the use of our conference call services. You are not permitted to sell “attractive PIN code” for monetary compensation. If Kongkow.com discovers pattern of abuse, we may choose to block your accounts from future use of our services.
6. PRIVACY POLICY: By using the Website and Services, You consent to the collection and use of certain information about You, as specified in Kongkow.com's Privacy Policy (the "Privacy Policy"). Kongkow.com encourages users of the Website and Services to frequently check Kongkow.com's Privacy Policy for changes. By using the Website and Services, You represent and warrant that You have read and understood, and agree to be bound by, the Privacy Policy. IF YOU DO NOT UNDERSTAND OR DO NOT AGREE TO BE BOUND BY THE PRIVACY POLICY, YOU MUST IMMEDIATELY LEAVE THE WEBSITE. If there is any conflict between any provision of this Agreement and the Privacy Policy, the provision of this Agreement shall control.
7. PROHIBITED USES: Kongkow.com imposes certain restrictions on Your use of the Website. You represent and warrant that You will not: (a) violate or attempt to violate any security features of the Website; (b) access content or data not intended for You, or log onto a server or account that You are not authorized to access; (c) attempt to probe, scan, or test the vulnerability of the Website, or any associated system or network, or breach any security or authentication measures without proper authorization; (d) interfere or attempt to interfere with the use of the Website or Services by any other user, host or network, including, without limitation by means of submitting a virus, overloading, "flooding," "spamming," "mail bombing," or "crashing" the Website or infrastructure that provides the Services. Any violation of this section may subject You to civil and/or criminal liability, and Kongkow.com reserves the right to cooperate with law enforcement in any investigation of any violation of this or any other section of this Agreement.
8. DELETION OF ACCOUNTS: Kongkow.com encourages users to log in and use conference call services on a regular basis. Accounts (including PIN code) may be permanently deleted due to prolonged inactivity (the customers have not used the service for six months or longer).
9. CHANGES TO TERMS AND CONDITIONS: We may change these General Terms and Conditions and/or any of the Additional Terms and Conditions at any time without notice. We publish the current version of our General Terms and Conditions and our Additional Terms and Conditions on our Website.
10. LIMITATION OF LIABILITY. NO AUDIO CONFERENCING SYSTEM IS COMPLETELY ERROR FREE. KONGKOW.COM DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED OR ERROR FREE, AND YOU ASSUME ALL RISKS ASSOCIATED WITH USE OF THE SERVICES BY CUSTOMER AND ANY OTHER PERSON USING YOUR ACCOUNT. KONGKOW.COM SHALL NOT BE LIABLE FOR PERFORMANCE DELAYS OR FOR NONPERFORMANCE DUE TO CAUSES BEYOND ITS REASONABLE CONTROL.
THE LIABILITY OF KONGKOW.COM AND ITS AFFILIATES, EMPLOYEES, AGENTS AND SUPPLIERS FOR DAMAGES ARISING OUT OF OR RELATED TO THIS AGREEMENT SHALL BE LIMITED TO THE AMOUNT RECEIVED FROM CUSTOMER HEREUNDER (IF ANY) IN THE PREVIOUS TWELVE (12) MONTHS. IN NO EVENT SHALL EITHER PARTY OR SUCH PARTY’S AFFILIATES, EMPLOYEES, AGENTS OR SUPPLIERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY OR CONSEQUENTIAL DAMAGES OR LOSS OF PROFITS, REVENUE, DATA OR GOODWILL, WHETHER IN AN ACTION IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY OR OTHER LEGAL THEORY, EVEN IF THE PARTY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
